These Terms of Service ("Terms") govern your access to and use of the website backgroundchecks.me (the "Site") operated by BackgroundChecks.me ("we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

01What We Do

BackgroundChecks.me is a marketing and lead-routing website. When you submit a search on the Site, we forward your search request to our service partner, PeopleLooker (operated by The Lifetime Value Co., LLC). PeopleLooker provides the actual public records lookup service and maintains its own membership, billing, and account relationship with you.

We do not maintain, edit, or verify the information that appears in PeopleLooker reports. We do not bill you — any charges you see related to a PeopleLooker membership come from PeopleLooker directly.

02Eligibility

You must be at least 18 years old and legally able to enter into binding contracts to use this Site. By using the Site you represent that you meet these requirements.

The Site is intended for users located in the United States. If you access the Site from outside the United States, you do so at your own risk and are responsible for compliance with your local laws.

03Acceptable Use

You agree to use the Site only for lawful purposes. Specifically, you agree not to:

• Use the Site or any information obtained through it to stalk, harass, threaten, defraud, or harm any person
• Use the Site to make decisions governed by the FCRA (employment, tenancy, credit, insurance, etc.) — see Section 4 below
• Attempt to access any area of the Site you are not authorized to access
• Attempt to interfere with, disrupt, or disable the Site or its underlying systems
• Scrape, copy, or reproduce content from the Site without our written permission
• Use automated tools, bots, or scripts to interact with the Site
• Misrepresent your identity or submit false information
• Use the Site in violation of any applicable law, regulation, or third-party right

04FCRA Restrictions

This section is important. Please read it carefully.

BackgroundChecks.me and PeopleLooker are not consumer reporting agencies as defined in the Fair Credit Reporting Act (FCRA). The data made available through this Site and PeopleLooker is not a "consumer report" as that term is defined in the FCRA.

You may not use any information obtained through the Site or PeopleLooker for any of the following purposes:

• Evaluating an individual for employment, promotion, reassignment, or retention as an employee
• Evaluating an individual as a tenant or for housing
• Making credit decisions or evaluating creditworthiness
• Underwriting insurance
• Evaluating an individual for a business transaction initiated by that individual (where FCRA permissible purpose would apply)
• Any other purpose covered by the FCRA or comparable state laws

You are solely responsible for your use of any information obtained through the Site or PeopleLooker. You agree to indemnify and hold us harmless from any claims arising from your use of such information in violation of the FCRA or any other law.

05Third-Party Services

When you submit a search, you are directed to PeopleLooker, a separate company. Your relationship with PeopleLooker — including any membership, subscription, billing, refund, cancellation, or data request — is governed by PeopleLooker's own Terms of Service and Privacy Policy, available at peoplelooker.com.

We are not responsible for, and make no representations about:

• The accuracy or completeness of PeopleLooker's reports
• PeopleLooker's pricing, billing, or subscription practices
• PeopleLooker's handling of your personal information
• Any interaction between you and PeopleLooker

06No Warranty of Accuracy

Information available through this Site and PeopleLooker is compiled from publicly available sources. Those sources may be incomplete, out of date, or inaccurate. Public records are processed and digitized by third parties and government agencies on their own timelines, and we cannot guarantee that any given record is current or correct.

You should independently verify any information before relying on it for any purpose. Do not make important decisions based solely on information obtained through this Site.

07Intellectual Property

The Site — including all text, graphics, logos, images, code, and design — is owned by BackgroundChecks.me or its licensors and is protected by copyright, trademark, and other laws. You may not copy, modify, distribute, sell, or create derivative works from any part of the Site without our prior written permission.

Trademarks and logos mentioned on the Site (including PeopleLooker, Google, Meta, and others) are the property of their respective owners and are used for identification purposes only.

08Limitation of Liability

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BACKGROUNDCHECKS.ME AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES — including lost profits, lost data, or damages arising from your use of or inability to use the Site — even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising from or related to the Site will not exceed one hundred U.S. dollars (US$100).

Some jurisdictions do not allow certain liability limitations, so portions of this section may not apply to you.

09Indemnification

You agree to indemnify, defend, and hold harmless BackgroundChecks.me and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Site, (b) your violation of these Terms, (c) your violation of any law or third-party right (including the FCRA), or (d) any information you submit through the Site.

10Termination

We may suspend or terminate your access to the Site at any time, for any reason or no reason, without notice. Sections of these Terms that by their nature should survive termination will survive.

11Dispute Resolution

Informal resolution first. Before filing any formal claim, you agree to contact us at support@backgroundchecks.me and attempt to resolve the dispute informally. We will respond within 30 days.

Binding arbitration. If informal resolution fails, any dispute arising from or related to these Terms or the Site will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration will take place in California or, at your election, in the state where you reside.

Class action waiver. You and BackgroundChecks.me agree that any arbitration or court proceeding will be conducted only in your individual capacity — not as part of a class action or representative proceeding. If this class action waiver is found unenforceable, the rest of this section will be void.

Exceptions. Either party may bring small-claims actions in an appropriate court and may seek injunctive relief for intellectual property infringement in a court of competent jurisdiction.

12Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Subject to the arbitration provisions above, any lawsuit permitted under these Terms must be filed in the state or federal courts located in California, and you consent to personal jurisdiction in those courts.

13Changes to Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, stop using the Site.

14Miscellaneous

Entire agreement. These Terms (together with our Privacy Policy) constitute the entire agreement between you and BackgroundChecks.me regarding the Site.

Severability. If any provision is found unenforceable, the remaining provisions will stay in effect.

No waiver. Our failure to enforce any right or provision is not a waiver of that right.

Assignment. You may not assign these Terms. We may assign them without notice.
